An early look at school budget

Superintendent of Schools Jeffrey Szymaniak presented a proposed draft version of the fiscal 2020 regional school budget to the School Committee on Wednesday, Dec. 12 at a meeting attended by town officials, state Rep. Josh Cutler, department heads and residents from Whitman and Hanson.

“We thought it prudent to get into the budget, and discuss where we are with the budget,” said School Committee Chairman Bob Hayes. “As you know, our budget is a lot dependent on what happens with the governor’s budget, so these numbers are preliminary off the history we’ve taken over the last [seven] years.”

Hayes said the intent was to give select boards and finance committees an early indication of what the schools’ numbers might be, with a budget discussion planned for every School Committee meeting until the May town meetings.

“It will give the towns the opportunity to see what the budgets of the departments are, where we’re going, how we’re going to get there and how we can possibly make it all work,” Hayes said.

The official school budget will be rolled out in February.

“I just wanted to apologize and take ownership if I have misled anybody in the process of this budget,” Szymaniak said, noting he had planned to give the finance committees the first look at it, after internal talks began in November. “Nothing formal has come out.”

He and district Business Services Director Christine Suckow had met with a budget working group over the fall to develop a capital plan for the next five years. He presented the budget numbers to the Whitman Finance Committee Tuesday, Dec. 18, despite some social media claims that it had already been discussed.

Szymaniak stressed he would not have done that before presenting even preliminary numbers to the School Committee.

“They represent their folks in the communities,” Szymaniak said of the department heads and town officials attending. “I represent the kids and the 600-plus employees here. I want to do my best for them.”

The budget at this point — and Szymaniak also stressed its preliminary status — is $53,457,929 [See site-based breakdown at top right]. That represents $2,934,748 over current budget of $50,523,181 for a level-service budget. Szymaniak said the preliminary numbers do not include revenues.

“This is a discussion,” he said. “This isn’t our formal presentation to the community.”

A budget book will be presented to town officials and the community in February, but the rough numbers provide information on the issues the schools are facing.

“We get Cadillacs for Chevys [price-tag],” Szymaniak said of teacher and administrator salaries. “But we won’t be able to maintain that if we’re not successful in a level-service budget next year. I will need to go back and do some damage to the good things and the positive things that we’ve done.”

Szymaniak ran through each school’s site-based expenses, especially utilities, custodial, transportation, phone and trash fees as well as district technology, facilities, debt, tuitions and special education and administrative costs.

Also included in technology services — at $1,371,365 — are salaries, contracted services, equipment maintenance and replacement, supplies and travel. Facilities costs — at $1,498,591 — include salaries, snow removal, contracted services, supplies, building and equipment maintenance, emergency repairs, fuel/oil, gas, police details and overtime.

Special education costs — at $6,177,353 are up by $750,000 from fiscal 2019 and include tutoring services, administrative support salaries, supplies, summer materials, travel, contracted services, legal costs, out-of-district placements and summer salaries.

Administration costs — at $4,103,043 — include central office salaries, School Committee expenses, supplies, legal costs, principals’ salaries, curriculum directors’ salaries, photocopying costs, contracted services and instructional materials.

Insurance — $8,171,802 —and debt — $890,938 —are also included in debt calculations.

“These are rough numbers, but I wanted people … to understand where we are,” Szymaniak said. “We are not adding any programs. What [Assistant Superintendent] George [Ferro] and I have done is restructuring things that we currently have and renegotiating … which might make some funds available to add programs out of the current level-service budget. We’re not adding people, we’re restructuring positions to potentially add services that are needed in the elementary schools.”

The district employs 664 staff members, including daily substitute teachers. There are 3,823 students enrolled in W-H, ages 3 to 22.

Ferro noted that the district is “on the hook for 100-percent of transportation costs” of students educated by out-of-district placements in special education programs.

School Committee member Fred Small agreed that the district is obligated to pay those transportation costs.

“I think the one key that’s missing, obviously, is to fine-tune what the revenue side is going to look like,” Small said.

Transparency

While he agreed that some people object to the level of administrative salaries, Szymaniak ($164,532 to increase to $168,645) said he and Ferro are transparent about their pay, which he said is in line with the rest of the state, excluding areas of western Massachusetts, where the cost of living is lower.

“Whatever you need to know, you just have to ask a question,” Szymaniak said, noting he is always available to answer resident’s questions on the phone or in-person at his office or even a local coffee shop. He will not discuss budget issues on social media, he said.

“I will not answer questions on Facebook,” he said. “I can’t win.”

Hayes reminded residents that the annual reports of both towns list salaries of all School Department employees.

“There is nothing hidden in this budget,” Hayes said. “This is a large operation for both towns to run and it gets expensive.”

Per-pupil expenditures in W-H, as of last week’s figures from the Department of Elementary and Secondary Education, show the district spends  $12,175.19 compared to a state average of $15,449.62.

W-H gets a bit less than 50 percent of its budget from the state.

Cutler discussed the state revenue picture with the School Committee.

The legislature has already begun its budget process with the consensus revenue hearing last week, Cutler said. Revenue growth for fiscal 2018 was stronger than previous years and fiscal 2019 is so far 4.1 percent over benchmarks, with potential for upsides, as surpluses are now called. For fiscal 2020, predictions are in the range for a $29.2 to $29.38 billion, or an increase of 2.9 or 3.5 percent, including a reduction in state income tax.

“On the economy, generally speaking, if I were a meteorologist I’d classify as it as mostly sunny with a chance of showers,” he said. “They were careful not to talk about the word recession — nobody wants to talk about that word —they did stress this kind of growth can’t continue, it’s not sustainable.”

Cutler said a recession is not forecast for 2020, but a slowdown is not ruled out.

Unfunded mandates

School Committee member Christopher Howard asked if Szymaniak could quantify all the unfunded mandates facing the district. Small suggested the under-funded mandates be included in that list as well as areas where revenues can be increased.

“What I would like to see our state do, somehow, is tie up our Chapter 70 money to a percentage,” he said. “Instead of a $20 to $25 increase per pupil, if the gave us a 2 or 2 ½-percent increase … I think we could solve a very large problem.” Increased state reimbursement for regional transportation, circuit-breaker funds and homeless transportation are the areas he cited were local representatives to the General Court could advocate for the district, according to Small.

The average cost to run W-H buses every day is $8,811.64, according to Szymaniak.

“The push-back that I hear at the state level in terms of the regional school transportation issue is they don’t want to give 100 percent,” Cutler said. “They feel if they do that, town’s don’t have skin in the game.”

Small countered that the district has skin in the game, having changed starting times on bus routes to save money and made efforts to obtain a better contract.

“Lack of competition when you go out to bid on a busing contract is really, really a big problem,” he said.

Inaction at JJ’s angers board

HANSON — The Board of Selectmen has lost patience with JJ’s Pub owner Patricia Harrison on her continued failure to meet court-ordered Dec. 15 clean-up deadline regarding debris from the July 5 fire that destroyed the building.

Selectmen authorized Town Administrator Michael McCue to give Town Counsel Katherine Feodoroff the green light to go back to court on Monday, Dec. 17 to seek enforcement of the clean-up order until it is cleaned or the property is sold to someone who will clean it up.

“From what we’re hearing, the property is under agreement,” McCue said during the Tuesday, Dec. 11 Board of Selectmen’s meeting. “I don’t disagree with this board [that] we want to see something in writing, but all that being said, it’s my strong opinion, along with the Building Commissioner [and] town counsel … that it’s not going to be cleaned up — and we’re not entirely sure that the new person who is supposedly buying this property is going to clean it up.”

Feodoroff recommended that Selectmen authorize her to go into court Monday, but was not necessarily seeking that OK yet, as she was trying to reach the potential buyer’s attorney to determine their real intentions.

“If there really is a buyer, that buyer is going to want to clean it up” McCue said, suggesting he come back with more information at the Tuesday, Dec. 18 with Feodoroff ready to go to court Dec. 19, if necessary.

McCue had argued against wasting more time and money going back to court against the current owner, and waiting until it can be determined if the property has been sold.

Selectmen were not feeling as lenient.

“We can’t control that, and I think this board has voted enough on that,” said Selectmen Chairman Kenny Mitchell. “If it’s not cleaned up on the 15th, send [Feodoroff] to court on Monday morning. If the property’s conveyed to a new owner, then we deal with that.”

Mitchell said that would not be a bad idea in any case, because a new owner would likely clean it up. He said the board was behind “Whatever it takes to get the damn fence up” or the debris cleared.

Selectman Laura FitzGerald-Kemmett agreed.

“Let’s get on with it already,” she said.

She said residents are fed up with the continued presence of the pile of burned debris at the site.

“You’re saying all the hearings and [court] orders and everything else that we’ve had with the current owner are going to be right out the window if that property is sold to somebody else,” FitzGerald-Kemmett asked McCue. “We’re going to have to start all over again?”

McCue said that would be the case if the property changes hands.

“How do we know if it’s in the process of changing hands right now?” she asked.

“We don’t know,” he replied. “Through the Building Inspector, we have it on rather good authority that it is going to be sold and I can’t confirm that.”

Mitchell said Harrison’s lawyer sat in a Selectmen’s meeting in October, saying the property was going to be  conveyed.

“I want Kate in court at 8:30 a.m. on the 17th,” he said. “We don’t want to talk about it anymore. Keep moving forward until somebody can bring me a deed that’s conveyed with a new owner. Then we can stop.”

McCue said a vote authorizing court action is required each time the property owner fails to comply with a previous order.

Sewer district

In other business, Selectmen voted to authorize McCue to explore a potential sewer district along Main Street (Route 27) in South Hanson with the city of Brockton and other state and local entities.

McCue has already attended one meeting with legislators and area officials “to start the conversation.” FitzGerald-Kemmett had also raised the issue at a recent meeting of the Old Colony Planning Commission (OCPC), McCue noted. OCPC indicated they would be willing to assist with evaluations and other groundwork, but the town will have to apply for a technical services grant.

“I think we’ve reached the point where, not only do I want the board’s support in going forward with requesting this grant — which we will get — but I want the board to, on a more official level, support the exploration,” McCue said. “You’re not making a commitment to go forward with a sewer district, but it is a rather massive undertaking.”

Brockton and Whitman — for carrying costs through Whitman’s system — are among the area communities involved, along with state legislators and other state government officials.

“I think it’s an extremely worthwhile endeavor in moving forward our vision for that particular stretch of road in South Hanson,” he said.

FitzGerald-Kemmett said she has also talked with state Sen. Mike Brady, D-Brockton, and state Rep. Josh Cutler, D-Duxbury, and OCPC to find out what they can do collectively to help.

“There’s a lot of hurdles, we’re not looking to bankrupt the town of Hanson to do this project — so it’s all about state funding, grants — and because it’s contiguous to a lot of very important bodies of water, and I have reason to believe that there might be some grant money and then we can talk about how the rest of this project could be funded,” she said. “This is just a preliminary discussion.”

FitzGerald-Kemmett said that, while the issue has been raised before, Brockton had not been open to allowing new connections in the past but are now revisiting it.

“Brockton has had the capacity,” McCue agreed. “They’ve had a great deal of capacity for years, but for whatever reason … wouldn’t allow any hookups.”

Maquan reuse

Selectmen also approved a request for proposals on the reuse of Maquan School. Survey responses from residents overwhelmingly favored use of the building for a community/senior center, but the Reuse Committee is not opposed to leasing at least part of the land or other underused properties in town.

“People want us to keep some playing fields there and they would like that community center/senior center,” FitzGerald-Kemmett said. “We keep hearing the middle school-aged kids have got nowhere to go … they’re getting into trouble, and I think with the opioid epidemic and all the other dangers out there, we can’t really risk having nowhere for them to go.”

The library has already begun studies on expanding at their existing space, but the Senior Center officials have expressed interest in using a portion of Maquan.

The case for fire services

WHITMAN — While town officials prepare the fiscal 2020 budget, resident Shawn Kain has advocated a more transparent document outlining the needs behind various funding requests.

Selectmen got a glimpse of how that might look in Fire Chief Timothy Grenno’s departmental report, which focused on how budget cuts might affect fire and EMT services in town.

Selectmen are also advocating a pre-Town Meeting, perhaps in March, to help explain the budgetary needs facing the town.

“This is the kind of document that, kind of, Shawn wants to have,” said Selectman Randy LaMattina. “As the chief was speaking, I’m thinking to myself, if this had a fixed asset list and a little bit of Article 2 numbers on it, then our Fire Department [report] is complete. The taxpayer’s going to be able to make an educated decision based off this.”

He said it may be the kind of document that all other departments should produce and, “with that, the budget document falls into place.”

Selecman Brian Bezanson said he did not think the board had ever been supplied that kind of comprehensive information before.

Grenno’s report was sobering.

“It has taken 10 years to get to where we are with six members per shift — shift staffing is what it’s all about — maintaining six people per shift gives this community the service that they demand,” Grenno said of his current budget outlook. “Anything less than what I have requested for fiscal 2020, will not be level-budgeted, but with contractual obligations, is a detriment to the fire service and the public safety in Whitman.”

Grenno forwarded his report to Selectmen, including a cost justification study. As of the Nov. 27 writing of his report, Grenno said the department had responded to 2,249 emergency calls in 2018 — 58.7 percent for EMS and 41.3 percent for fires — illustrating that the shift had gone from all fires in the 1960s to mostly EMS by the 1990s when the difference began to even out by the 2000s.

“Those numbers justify what we’re doing every day,” he said. “That type of call volume demands the level of service that we’re currently providing.”

The three firefighters added in 2016 marked the first addition of staffing to the department since it went full time in 1965, according to Grenno. Fire-based ambulance had been added in 1973 with no addition to staffing.

“It’s a document that we need this year, obviously we need it,” said Selectmen Chairman Dr. Carl Kowalski, apologizing that he had not yet had the chance to study the report.

On a positive note, the number of overdoses responded to by the Fire Department is down to 29, from more than 40 last year. Grenno said the availability of Narcan may be helping some people treat family members or friends without calling 911. He did caution that Narcan is short-acting and one dose is often not enough to counteract some of the opiate drugs out there.

“So the overdoes we are seeing are very significant,” he said.

Key points of Grennos’ cost justification study were:

• A second ambulance is “saving a significant amount of critical patients” who would be at risk without it. “Without staffing, these patients, who would have had to wait an excess of 10 or 15 minutes for an outside ambulance, it would have been fatal to them,” Grenno said.

• Grants are a significant revenue source, including a $6,500 SAFE grant, which funds fire education in the schools. A grant for a bit more than $230,000 replaced outdated self-contained breathing apparatus. Grenno has also applied for a $35,000 grant to replace the generator system at the fire station.

• A budget cut of between 3 and 6 percent would have a “significant impact” on services, according to Grenno, who has asked the Finance Committee for the number they predict will be available to the Fire Department before he provides a specific impact statement.

Feeling the cuts

Fiscal 2020, begins the third year of a collective bargaining agreement that would put the deputy chief on days and add new OSHA regulations, which go into effect in February 2019, under his responsibility.

“We need $300,000 just to make our building OSHA-compliant,” Grenno said. “We’ve got a lot of problems facing us down the road.”

A 3-percent reduction of $3,737,895 would eliminate that position, keeping it on shift. It also “pulls the Fire Department back 10 years from where we are today,” Grenno said, eliminating any small services for the community, including touch-a-truck events for fundraisers, banners and other events.

The IT position, which includes reporting software for providing data to the state, as well as building the database of critical information to firefighters in the field through the dispatch system, would also be eliminated. Light maintenance would also be cut from the budget under a 3-percent reduction, with out-sourced repairs costing about $260-$300 per hour.

Storm coverage would have to be eliminated, as well, Grenno said. Instead of up-staffing at a cost of between $30,000 and $40,000 to respond to downed trees and power lines as they happen, calls will be prioritized and stacked as they come in.

“When we get there, we get there,” he said.

The two-member call department would be eliminated and reduce training officer availability to eight hours per month. The EMS officer would be reduced to 20 hours per month, where Grenno had planned to negotiate placing that officer on days in a supervisory role.

“That will threaten our certification, quite frankly,” Grenno said. Call-back and overtime would also have to be reduced, risking an empty station at times.

Budget document

Kain, a former member of the Finance Committee, had kicked off the meeting with a request for an update on progress toward a capital plan and budget document during the public forum.

Town Administrator Frank Lynam said the process is underway, but staffing shortages affect it. The town has received grants for both the budget model and capital planning. The Collins Center at UMass has presented a proposal and two others are being looked at for a capital plan, but all are telling the town they are looking at about three months of work.

That will be done parallel to the current process in order to complete the budget.

“Having a professional budget document is excellent, but something for the public to analyze as this process continues will be extremely helpful,” Kain said, noting that Article 2 is helpful for people who know what they are looking at, but that it is not detailed or user-friendly.

Lynam said a general outline is not yet available but that Article 2 is detailed, but that a format with historical background will take more time and argued the public has been well informed of the budget cost, increasing percentage of debt and school budget impact.

“What we have are departments projecting what would happen if the budget is cut 3 percent or if the budget is cut 6 percent,” he said. “I stated at our last meeting, I don’t think that is the approach we should be taking. We should be building parallel budgets — one with cuts and one that will identify what we need to seek in additional funding to make that work.”

Worst-case planning: Whitman departments offer forecast for impact of cuts

WHITMAN — Town officials are preparing worst-case budget scenarios to help prioritize needs.

Town Administrator Frank Lynam and Selectman Scott Lambiase reported to the Board of Selectmen Tuesday, Nov. 20 on progress with the fiscal 2020 budget. Lynam said he has begun receiving budget proposals including 3-percent and 6-percent budget cuts, to help forecast the effects if such cuts are needed as the town addressed the current levy limit and town financial obligations.

The problem Lynam said he has seen so far is that the budget proposals have included expense lines, such as debt payment and utilities, where cuts can’t be made.

“I would be remiss not to point out that, while we’re working on this, there is still an elephant in the room and I think we need to step up the pace,” Lynam said.

He also said net metering and the change to LED streetlights will help save some money, but there are other obligations such as health insurance and contractual obligations that must be paid.

“The purpose of asking for the 3-percent and 6-percent budget from everybody was to get that exercise going and to get them to realize that its going to be deep and meaningful cuts if we have to make them, and we have to get everybody’s head wrapped around what that is going to look like if we want people to understand that we may be — or most likely will be — looking for some sort of operational override,” Lambiase said.

Benton said he has already begun talking to his officers about the “very real possibility of layoffs.”

“The quickest that we can get to a number that we, as department heads, can figure on it’s going to help us,” Benton said. “I don’t want to wait.”

Lynam said the schools had projected a 5-percent increase due to rising operating costs — a $1.4 million increase — with no anticipated increase in Chapter 70 aid.

“We’re not talking increases this year — we’re talking reductions,” he said, noting there have been recommendations from some town officials against using the $1.2 million in free cash for levy expenditures, including on the $836,000 debt service for the police station.

Combined growth is $900,000.

Police Chief Scott Benton said that, since town administrators’ salaries are voted on at Town Meeting, that information concerning school administration salaries are, in the interest of greater transparency.

“Ultimately, the schools are responsible to the town, just as the selectmen are and the other departments are,” Lynam said. “It doesn’t make sense not to give people what they’re looking for, because if you want someone’s support, they need to understand why you’re asking for it.”

Lambiase said he has the impression from budget discussions that the school district intends to do that and wants to do so.

“They know the predicament that we’re in,” he said.

Selectman Brian Bezanson said the district has to remember that Whitman was “very kind” to the school budget last year, and that there could be “a lot of ill-will in this town, going forward, if these town departments get ruined and they are just going merrily on their way.”

Lynam cautioned against pitting the schools against the town.

“Remember, they are part of us,” Lynam said. “It can’t be an ‘us and them’ but there has to be an understanding among us, too. If we’re able to present a sound, well thought-out, well-justified budget, then it’s up to Town Meeting to say yes or no. If they say yes, we all benefit from it — if they say no, we all lose.”

Police chief report

Benton reported to Selectmen that there has been some good news in town concerning the opioid crisis.

While there have been 29 overdoses, with two fatalities, so far this year — compared with 40 overdoses with five fatalities at the same time in 2017. But he cautioned that it might not be a complete picture of the situation.

“To bring it into focus, the more Narcan that’s present, and people are also able to get Narcan from the pharmacy, sometimes you won’t even have anybody call on an overdose situation,” Benton said.

He added that education and enforcement have made a significant improvement. Plymouth County Outreach has won a national community policing award as well as a $500,000 grant to allow hiring a full-time administrator and records keeper, pay for recovery coaches, host officer and team member training and to fund a data base.

Whitman, Bridgewater, Middleborough, Bridgewater State and East Bridgewater are also jointly applying for a Jail Arrest Aversion Grant to address mental health issues relating to calls for police services.

“Obviously in an emergency [if] a person is in distress, threatening to harm themselves of something, they’re going to be transported right away, but the follow-up will be when this clinician comes in, similar to what we do with the Plymouth County Outreach,” he said. “I think we can all agree that mental health is at the forefront of a lot of issues we deal with.”

A grant was also secured for radio infrastructure, to clear up the town’s communication dead spots, through the efforts of IT Director Josh MacNeil.

“What makes this grant amazing is we had so little time,” Lynam said. “We found out literally days before it had to be submitted.”

Benton also reviewed recent high-profile arrests, including the arrest of a Rockland murder suspect and several drug and weapons arrests.

He also said enforcement regarding parking on sidewalks had not been done much in the past, but in light of a complaint on an ADA basis from a resident who uses a wheelchair, the department has begun issuing warning cards as they plan to begin enforcement.

“I will tell you this,” Benton said. “If the officers realize this is the third time they’ve put a warning on your car, you may wind up getting a civil fine anyway.”

Winter parking ban

Lynam announced that the annual winter overnight parking ban — 11 p.m. to 6 a.m. — goes into effect on Saturday, Dec. 1 through April 1, 2019 to enable snow removal. Tickets will be issued to violators and, if a vehicle impedes snow removal, it will be towed. That includes the town parking lot next to the former First Baptist Church on Washington Street.

Solid waste fee

The board voted that trash fees are going up $36 to $285 for fiscal 2019. A $25 discount for seniors who own their homes was approved for trash fees for the 596 residents receiving water discounts to begin in fiscal 2020.

Nov. 6 Election

Lynam also shared some observations about the recent state election.

“It was really an incredible turnout — over 4,000 people came out and that’s in addition to the 2,000 people who voted early,” Lynam said. While he said the day went rather smoothly, the one observation he would make it was that parking was “an absolute disaster.”

“Part of that can attributed to the fact that employees — both town employees and election workers or part-time employees — parked in the town parking lot,” he said. “That should not happen.”

Lynam recommended that in any future years in which a state or national election is held, parking in the Town Hall lot and in front of town hall be reserved for citizens trying to vote. Parking would be provided near the police station, with transportation to Town Hall provided by COA vans.

Veterans affairs

Veterans’ agent Thomas McCarthy reported that Whitman was well represented at the annual Tri-Town Veterans Day Parade with the Fire Department Honor Guard winning first place and Police Department Honor Guard taking third. The WHRHS band won first place for the band performances and the W-H majorettes took third.

McCarthy said a Veterans Day Parade committee is being formed to improve planning. Selectman Dan Salvucci noted that both Abington and Rockland have longer routes that Whitman and that the town should organize a longer route when it hosts the parade next year.

Hiring a legal team

HANSON — Selectmen on Monday, Nov. 19 completed the last of five first-round interviews with law firms seeking a new contract for labor and/or general counsel services to the town.

The process, begun Nov. 13, is expected to continue with a discussion and selection of two final candidates at the Tuesday, Nov. 27 meeting for a second round of interviews on Tuesday, Dec. 11. Town Administrator Michael McCue hopes a decision can be made by Dec. 18. He began the process in an effort to ensure Hanson was getting the best legal advice it could afford as part of his goals for the year.

“This is a major decision and I strongly advise the Board of Selectmen to choose two … and have them back again for a second round,” McCue said. “You’re not married to the 18th. If his board can’t come to a decision — if they’re not comfortable, if there’s not a majority — we can revisit the way we’re doing it.”

The firms interviewing have been: Clifford & Kenny LLP of Pembroke and Murphy, Hesse, Toomey & Lehane MHTL of Quincy on Nov. 13 and current town counsel Mead, Talerman & Costa of Millis; Brooks & DeRensis of Boston and current labor counsel Norris, Murray & Peloquin LLC of Norwood on Monday.

Clifford & Kenny and Norris, Murray & Peloquin are applying for labor counsel services only and the other three are applying to offer both general and labor counsel services.

McCue said any of the five would be a qualified selection.

“What I’ve requested the Board of Selectmen to do is, by Nov. 26, send me the two top firms that you’d like to see again,” for general counsel and labor counsel, McCue said. He and Selectmen Chairman Kenny Mitchell had discussed the process and agreed on that step, but Selectman Jim Hickey asked why a discussion in open session was not being considered as the next step.

“As a group we don’t get to discuss at all what we think?” he said.

“I have a problem with sending Mike a vote email,” Dyer agreed. “I think we should have a group discussion about all five of them between all five of us here. We all come from different expertise, you guys have been on the board longer than I have, and I think your insight would be really valuable to my vote — and then there’s open government. … I think we need to be open and transparent with this,”

Selectmen Laura FitzGerald-Kemmett and Wes Blauss also saw merit in public discussion before narrowing the field of candidates.

“I want to hear [the others’ thoughts] because maybe I missed something,” FitzGerald-Kemmett said, noting that some sort of rubric by which to judge the firms.

“I’m all for efficiency, I’m all for transparency [but] Matt represents a new generation who, nationwide, are demanding transparency in government — and not necessarily getting it,” Blauss said. He volunteered to start off discussion at the next meeting, explaining his top two picks.

McCue, who had provided on-page summaries on the firms, including their size, how long they have been in business, client base and proposed cost, said all five are qualified.

“All five of them are highly qualified firms, the only differences … have to do with how many people work for that firm, the years of business and the amount of municipalities they represent,” he said. “I have experience with all of these firms.”

He said he had no objection to any process the board wished to pursue, but was concerned that a “free-wheeling conversation” about five different firms could result in the board being at loggerheads.

Mitchell said his experience on the police chief search committee, which had narrowed a field of 49 applicants to the two finalists brought before Selectmen for interviews.

“I don’t know that it makes sense taking all five and all of us have the same opinion about one, two or three, when we could narrow it down and then have that deep discussion about those one or two,” Mitchell said.

Applying as labor counsel, Clifford & Kenny is a small firm with two partners and three associates founded in 2013 by partners with a dozen years of legal experience a piece. They currently represent 20 municipalities including Rockland, East Bridgewater, Marshfield and Fall River.

“We’re very respectful of the relationship with the unions,” said partner Jamie Kenny on Nov. 13. “We don’t go scorched-earth. … These employees are normally long-term employees, they are valued employees and we want to work together to try and reach a resolution that everybody can live with.”

Applying as both general and labor counsel, Murphy, Hesse, Toomey & Lehane has a team of 31 attorneys and was founded in 1986 with a 150-municipality or government department client base, but assured selectmen they don’t practice the “hot potato” approach to client representation, according to associate Michael Maccaro.

“We want you to know that, when your issue comes up, that’s the most important issue to us that day,” he said.

The firm has dealt with all labor unions active in the state and a diverse group of municipalities.

“We just make the policy decisions and help you get to where you want to go,” said associate Cynthia Amara.

Current town counsel firm Mead, Talerman & Costa is also applying to become labor counsel this go-round. Founded in 2004, the firm has 10 attorneys, but Jay Talerman would remain as lead general counsel — as he has been since 2014 — with Kate Feodoroff taking the role of labor counsel. She has been lead union contract negotiator for the city of Brockton before joining the firm. The firm represents 16 towns as general counsel and five as labor counsel.

“I hope that we’ve been responsive to you in the past and we will continue to do so,” Feodoroff said. “We like to address problems before they become problems and have solutions — and multiple solutions — so that you can choose from them.”

She said the firm has an open-door policy with McCue.

Brooks & DeRensis, founded in 2018, is also applying for both general and labor counsel. The firm’s 10 attorneys have deep experience  on “both sides of the table” in both political and legal service, and also represent Canton, Mansfield and Randolph for both general and labor counsel. They represent several regional school districts, and have experience helping towns with economic development, as well.

“We’re the ones who are practical and are driven by common sense,” said partner Paul DeRensis.

Current labor counsel Norris, Murray & Peloquin has four partners and Leo Peloquin would remain the lead attorney for Hanson. Founded in 1997 as Collins, Loughran & Peloquin LLC, the firm represents 24 cities and towns and 13 school committees as well as Middleborough Gas & Electric and the Wareham Fire District/Water Department.

“I hope when you look at our record with the town that I treated it like a privilege,” Peloquin said, noting that less than 1 percent of cases he works goes to litigation. “We help [you] get things done.”

They provide towns with a monthly newsletter updating developments in labor law.

“They can say to you, ‘This is what we can do for you,’” Peloquin said of the competing law firms he knows and respects. “I’m sitting here tonight saying, ‘This is what we’ve done for you.’”

All firms except Norris, Murray & Peloquin have partners or associates who have served in elective office. All five noted the need for regular reviews of sexual harassment policy, especially in the wake of the #metoo movement. The firms provided fee estimates for both hourly and flat rates, while most advised that hourly rates may be more a accurate reflection of services received.

If a conflict arose between the towns of Hanson and East Bridgewater, which is involved in an inter-municipal IT agreement with Hanson, firms applying as general counsel indicated they would either step back from the issue or did not represent East Bridgewater. ‘More like family’: Zamagni an inspirational presence on girls’ soccer sideline

Tom Zamagni has coached at Whitman-Hanson for 24 years.


In Tom Zamagni’s office, there’s little space left empty, and he wouldn’t want it any other way.

Every banner hanging signifies pride, every scrapbook sitting on the table causes a chuckle, every picture adorning the wall recalls a memory. But they all signify relationships.

It’s a collection — that’s inching into his sitting room — Zamagni has been piecing together for the past 24 years he’s been prowling the Whitman-Hanson Regional High girls’ soccer team’s sideline. It’s journey that began from an inside tip.

“My oldest daughter came home as I believe a sophomore and said, ‘Dad, there’s no JV coach right now up at the high school,’” Zamagni recalled. “I thought, ‘Well, I think I know enough to go up and do that.’”

One of his favorite photos lies in a scrapbook. It’s of him and David Floeck walking down to Dennis M. O’Brien Field for practice. It’s a friendship that formed nearly 22 years ago after Zamagni was ready to quit coaching after two seasons due to a heavy workload off the field in the finance industry.

“I told him, ‘You need to join me at the varsity level and when you can’t make it, it’s not a big deal,’” Floeck said. “And I don’t think he’s ever missed a day in all these years.”

Floeck found Zamagni’s multi-sport knowledge appealing. This stemmed from his time playing shortstop and coaching St. Joseph’s The Worker Catholic Church’s softball team, as well as playing baseball.

“He brings a different perspective or a way of looking at something from his athletic background,” Floeck said of Zamagni. “From my perspective, it makes me kind of think about the decisions or some of the things we look at, and I really find that to be awesome because it challenges me as a coach and it helps me to see things from many different angles.”

Messages conveyed

Under Floeck, Zamagni initially served as the goalkeeper coach. Kerry Flood, a 2010 W-H alum, spent four seasons being coached by Zamagni in net.

“He had a significant impact on my development as a goalkeeper, since I had never been committed to the position prior to high school,” Flood said.

Flood, who can be seen in numerous pictures around her former coach’s office, said Zamagni provided a wealth of knowledge and source of inspiration on the sideline during her playing career. However, his most impactful moment to her came in 2009 prior to a state semifinals game against Acton-Boxboro.

“To say I was nervous was an understatement, as we had been preparing for this moment all season,” Flood recalled. “I remember my conversation with coach Z before that game. He told me, ‘Do not let the moment be bigger than you. This is a quality team and you are a very talented keeper. Stay focused and give it everything you have.’”

It’s simple messages like that Zamagni hopes resonate with his players.

“The most important thing for me is trying to teach the kids life lessons through soccer and then they come back years later and tell us what a wonderful experience they had,” he said. “Sports is like life situations, so if bad things happen to us, that’s life. We fall behind, I say, ‘Now what? So what? What are we going to do about it?’”

Flood rejoined the program in 2015 and eventually took over training the goalkeepers, while Zamagni shifted to drawing up game plans for the defense, but he still keeps his eyes on the whole field.

“He sees things from a different perspective and sometimes I come back and say, ‘No way, that won’t work,’” Floeck said. “Then a few minutes later I’m like, ‘Well, what I’m doing isn’t working so maybe it will.’”

Sometimes it’s minor – like a defensive adjustment.

“He’ll say, ‘Listen, we really need to put this player on this side, it’s a better matchup for us,’ and I’ll say, ‘Jeez, no,’ and he’ll say, ‘Listen, will you just give it to me please and let me do it?’” Floeck said. “And I’ll capitulate and we’ll do it and a lot of those times he’s spot on.”

Relationships through coaching

Over Zamagni’s 22 years as Floeck’s assistant, the Panthers haven’t had a losing season since 1999, have won numerous Patriot League titles and made a trip to the state finals. The success is gratifying, but the bonds he has created along the way are even more rewarding. He’ll even miss work to watch a W-H girls’ soccer alum, such as this past season when Marina Kelly, class of 2014, returned to Dennis M. O’Brien Field in a different uniform – as Scituate’s JV soccer coach.

“I had to cancel a meeting so I could get up there and see it,” Zamagni said.

In his spare time, Zamagni, if not at the youth soccer field in Hanson watching his grandchildren play, is keeping tabs with alumni — whether it’s a trip to Rhode Island to watch them play, a simple text or over breakfast.

Flood said it’s that type of dedication to the program’s alumni that makes Zamagni an irreplaceable presence on the sideline.

“Coach Z keeps all of the alumni informed as to which games to go to and how the current team is doing,” Flood said. “It is great to see former teammates coming to our games and cheering on the program. Coach Z keeps in touch with many of his former players and continues to have an impact on their lives.”

Past team captain and freshman at Manhattan College Eve Montgomery said Zamagni’s selflessness stood out to her.

“He would be standing there from the sidelines supporting me no matter what,” Montgomery said. “He does everything and anything he can to help better other players. That’s what makes him so special. I believe he’s a vital part of the Whitman-Hanson soccer team [and] without him there’s a piece of the team missing.”

Former All-American Lauren Bonavita, currently playing at UMass Amherst, said Zamagni was more than just a coach to her.

“He calmed me down when I need it and challenged me when he needed more from me,” Bonavita said. “He’s more like family to me and I know I’m not the only one who thinks of him this way. I’m grateful for his coaching and friendship.”

Reason to return

Zamagni said his main motivation to come back every autumn is because of the bonds he creates.

“There’s five or six seniors that I don’t really want to leave,” he said. “That continues every year, so I don’t know how I’m going to retire because there’s always those seniors that are there that you have that special relationship with. It’s hard to think about walking away.”

And walking past countless memories from the past two-plus decades in office on a daily basis plays a major role in that mindset.

“It keeps me going,” Zamagni said. “You can’t put a price tag on that.”

Red ink at the transfer station

HANSON — What do you do with the town’s trash when recycling becomes an expensive problem?

The Board of Selectmen has begun discussing with the Board of Health ways to salvage its financially troubled transfer station as well as the environment with a two-pronged approach: find a way to make the facility solvent and possibly ban plastic grocery bags, if not polystyrene cups and plastic straws as well.

Town Administrator Michael McCue said the transfer station is two years away from a financial crisis.

“A lot of it has to do with the fact that overseas recycling has been pretty much shut off and the cost of recycling has been that much more expensive,” McCue said. “The transfer station has had to rely on some of its retained earnings and I think a conversation needs to take place of how the two boards think we should move forward to contain the viability, on some level, of the transfer station. … We need to start the conversation.”

Options right now, according to Health Board member Arlene Dias, include continuing current practices, reducing transfer station hours to save money, returning operation costs to the tax base or explore regionalization. Looking to data on when the transfer station is most used can also guide when hours are most efficient.

“Better to start the conversation now, before we reach … the inevitable wall that we might be hitting,” McCue said. He indicated the next steps would include a working session between Selectmen and the Board of Health, along with members of the Finance Committee and town accountant to begin the planning process. A public forum is also planned, and a meeting Selectmen want to see happen first.

Town Accountant Todd Hassett said the facility is “treading water” this year, which includes an $86,000 tax subsidy and  $57,000 drawdown of retained earnings.

“We’re at a point where, in two years, the retained earnings would be completely used up and we’d be looking at closer to $150,000 in tax subsidy to support the overall program,” he said.

China’s decision last year to halt acceptance of solid waste for recycling — due to contamination of materials not cleaned properly before being disposed of — has caused transfer station costs to skyrocket across the United States. Health officials are also concerned about the prospect of Rhode Island waste companies that now take trash from Massachusetts may also halt that one day.

“If we taught people to do a better job [recycling], we’d be better off,” Dias said.

“We’re talking about busy families,” Selectman Jim Hickey said. “That family is not going to rinse out the bottle of ketchup … it’s going to go in the recycling and they’re going to mix it with the plastic syrup container that they used.”

Dias said one of the Finance Committee’s members has advocated just closing the transfer station completely to save money.

Board of Health member Gil Amado said the system does work at the transfer station, and while recycling has changed throughout the world, the problems are cyclical.

“It comes back,” Amado said. “It goes in cycles and I think Hanson is very fortunate.”

While the Health Board members did not have figures at hand on how many residents use the facility, they do have that data and admit that transfer station use had been declining.

Still, there are people who have tried private haulers and prefer the transfer station. Dias said in her case, the one bag of trash she throws away separate from recycling was not enough to justify the cost of a private hauler and she went back to using the facility.

Selectmen Chairman Kenny Mitchell said the town’s pay-as-you-throw program had been sold to the town on the promise that it would eventually become self-sustaining.

“Based on the numbers that I’ve seen — and you can show me different numbers — it’s not,” he said. “It’s going the other way.”

“I hate to reduce hours, because it feels like we’d be reducing service and we’ve got a lot of busy families out there,” Selectman Laura FitzGerald-Kemmett said. “It’s a balance of economics and service. We really have to find the right balance there.”

Selectman Wes Blauss said that recycling efforts need not take as much time as people might think.

“I am a firm believer in the transfer station from when it was a dump up to now,” Blauss said. “You do it for the planet. We’re not going to get China back. We have to keep the transfer station viable.”

Selectman Matt Dyer said the transfer station is a needed service that the town must find a way to fund.

“Recyling is very near and dear to my heart,” Dyer said. “I don’t believe that getting rid of recycling is the way to go, either, because as we all know, we only have this limited amount of resources. … We’ve already messed up our planet enough. We need to suck it up and pay the right price.”

He suggested a town forum to gather more ideas for a solution to the problem.

Amado advocated, “throwing it back on the taxpayers.”

“Financially, I don’t see that as an option,” Mitchell said, noting the town can’t wait two years to arrive at a solution. “What I would like to see is, down the road … not closing it, keep it open a couple days for mattresses and tires, but then have residents be in charge of getting rid of their own trash.”

Health Board member Theresa Cocio said the elderly and people with smaller households that produce little trash and/or can’t afford a private hauler must be considered.

“Recycling is the biggest cost,” she said. It is now almost $20 more per ton than trash.

“We don’t know what’s going to happen moving forward,” said Dias, who is also the town’s representative to the South Shore Recycling Cooperative. “Every town is having the same problem.”

Town curbside pickup is unworkable because of Hanson’s geography, Amado said.

A plastic bag ban, one of the proposed Selectmen’s goals suggested by Blauss was also discussed, but Dias said South Shore Recycling sees the process for treating paper is much more harmful than plastic bags, a contention with which Dyer took issue.

While producing paper bags is polluting, it also does not use the oil from which plastic is manufactured and the lifespan of the products are vastly different.

“Paper bags are going to degrade in a couple of weeks and a plastic bag is going to sit in a tree and kill birds and cats …,” Dyer said. “Plastic bags go from the store to your car, from your car to inside, then they go in the trash. It’s a single-use [item] creating a bunch more waste.”

Almost 90 communities in the state, and most towns on the South Shore, already ban plastic bags, according to Dyer.

“We are the stewards of the Earth,” he said, also advocating the banning of polystyrene cups and plastic straws. “We already messed up the Earth so much, its time to correct our actions and move in a positive direction.”

Warren wins 2nd term

The door to the U.S. Senate may have just closed on Geoffrey Diehl, but the former state representative says he is now searching for his window to the next opportunity.

Statewide, Warren held a 60-36 margin of victory over Diehl based on unofficial results with Independent Shiva Ayyadurai taking about 3 percent of the votes cast. Locally, the picture was a mirror image for Warren and Diehl, as the Whitman Republican took his hometown of Whitman by a 3,888 to 2,641 margin of 6,776 votes cast. Hanson voters went for Diehl by a larger margin — 3,104 to 1,909 for Warren. Ayyadurai garnered 175 votes in Whitman and 124 in Hanson.

Hanson also narrowly voted to support two town ballot questions — 2,641 Yes to 2,354 No on Question 1 and 2,630 Yes to 2,357 No on Question 2 — that prohibit retail cannabis businesses in town.

Diehl’s strongest bases of support were on the South Shore, central Worcester County and towns southwest of Springfield.

“We left no stone unturned,” Diehl said to supporters Tuesday night at the Whitman VFW. “And I know I gave it my all, but I also know that you gave it your all.” He quoted a 19th-Century philosopher’s dictum that, “If you learn from a loss, you really haven’t lost.”

Diehl said he was very glad to have the chance to debate incumbent U.S. Sen. Elizabeth Warren, D-Mass., and talk about the issues.

“I’m hoping that she will focus on those issues that are important, whether it’s law enforcement, the fishing industry or the other issues we brought up,” Diehl said. “So, while the outcome is not what we wanted, we’ve laid the foundation for taking Massachusetts back for the working people.”

Warren, making her victory speech after 11 p.m. in Boston vowed to do just that, as well as to continue fighting to empower women.

“Together, women and men, young and old, black and white, gay and straight in cities big and small have built something extraordinary,” she said, telling the crowd they have more power than they ever imagined and “you gotta stay in the fight. … It’s going to be hard, nevertheless we will persist and we will deliver the change our country deserves.”

Warren lauded Diehl for “stepping up” and taking on the hard and expensive task of running for office, thanking him for his efforts along with all others who campaigned for office or supported one.

“You make democracy work,” she said. “Whether you voted for me or not, I am grateful for the opportunity to fight for you.”

Diehl addressed his supporters in a short, gracious concession speech shortly before 9 p.m., Tuesday, Nov. 6. His race had been called as a victory for Warren shortly after polls closed at 8 p.m. — first by the Associated Press and then by other news outlets including CBS. It had been a long day of traveling around the state for last-minute meet-and-greets with voters.

Around the ballot

Whitman supported Gov. Charlie Baker and Lt. Gov. Karyn Polito 5,031 to 1,457 for the Democratic ticket of Jay Gonzalez and Quentin Palfrey. Hanson backed Baker/Polito 3,949 to 1,003 for Gonzalez/Palfrey.

Attorney General Maura Healy won both towns, with a 3,897 to 2,699 margin over Republican James McMahon III in Whitman and by a close 2,756 to 2,287 in Hanson.

Secretary of State Bill Galvin received 4,233 votes in Whitman and 3,071 in Hanson to Republican Anthony Amore’s 2,065 in Whitman and 1,820 in Hanson. Green Rainbow candidate Juan Sanchez Jr. got 178 votes in Whitman and 104 in Hanson.

Treasurer Deborah Goldberg garnered 3,639 in Whitman and 2,620 in Hanson to Republican Keiko Orral’s 2,566 in Whitman and 2,186 in Hanson with Green Rainbow candidate Jamie Guerin getting 102 Hanson votes and 183 in Whitman.

Auditor Suzanne Bump held off three rivals, and gained 3,485 votes in Whitman and 2,430 in Hanson with Republican Helen Brady a close second with 2,592 in Whitman and 2,272 in Hanson. Libertarian Daniel Fishman received 212 Whitman votes and 167 in Hanson while Green Rainbow candidate Edward Stamas took 104 votes in Whitman and 60 in Hanson.

Whitman’s Congressman Stephen Lynch, running unopposed, received 5,206 votes in Whitman. Hanson gave U.S. Rep. Bill Keating, D-Mass., fewer votes — 2,470 — than his Republican challenger Peter Tedeschi received — 2,536 — but Keating took the win by a 20-percent margin in the district.

Governor’s Councilor Christopher Iannella won a handy re-election with 4,871 votes in Whitman and 3,547 in Hanson against a handful of write-in votes.

State House races were won locally by Abington’s Alyson Sullivan in the 7th Plymouth District [see related story], taking Whitman with 3,757 votes to Democrat Alex Bezanson’s 2,753.

Hanson state Rep. Josh Cutler, D-Duxbury, was unchallenged in the 6th Plymouth District, taking 3,823 of the votes cast.

State Sen. Mike Brady, D-Brockton, was also re-elected, taking Whitman with 3,698 votes to Republican Scott Hall’s 2,719 and Hanson by 2,656 to Hall’s 2,230.

Plymouth District Attorney Timothy Cruz won re-election with the help of 4,111 votes to Democrat John Bradley Jr.’s 2,425 in Whitman and with 3,331 to Bradley’s 1,656 in Hanson.

Robert Creedon, running unopposed for Plymouth County Clerk of Courts got 4,965 in Whitman and 3,619 in Hanson. Also running unopposed, Registrar of Deeds John Buckley Jr., tallied 3,612 in Hanson and 4,984 in Whitman. Unchallenged County Commissioner Sandra Wright won 3,782 Hanson votes and 4,911 in Whitman.

Only state Ballot Question 1 on nursing staffing went down to defeat — by a 2-to-1 margin statewide and with 3,720 No votes to 1,397 Yes in Hanson and 4,833 No votes to 1,759 Yes in Whitman.

State Question 2, seeking a U.S. Constitution amendment to limit the influence of corporate money in elections won by a 71-percent to 29-percent margin — with 4,270 Yes votes to 2,301 No in Whitman and 3,173 Yes to 1,811 No in Hanson. State Question 3, to continue protections of transgender rights won with a state margin of about 68 percent to 32 percent, and with 3,734 voting Yes to 2,906 voting No in Whitman and 2,803 voting Yes to 2,285 voting No in Hanson.

Early call

The Senate race result, and the fast call was met with anger and disbelief by Diehl supporters, including Whitman School Committee member Fred Small.

“How can they call it so fast?” he demanded.

Former sports broadcaster John Dennis, who has become a fixture at Diehl campaign events, also expressed disappointment in the results as he introduced Diehl.

“The results aren’t what we wanted them to be,” he said, noting some people calling him during the evening had asked if he was upset or angry. “I think the word is disappointed, but I want to make it clear that I’m not disappointed in Massachusetts voters — I’m disappointed for Massachusetts voters.”

He said, in his opinion, the state has missed a golden opportunity to be represented in the Senate by “a man of integrity and compassion and commitment.”

But looking on the bright side, Dennis said he made a valuable lifelong friend in the process, introducing Diehl.

Earlier in the day, Small and fellow School Committee member Dan Cullity had predicted a Diehl win that would shock the nation.

“Everywhere I go, everyone I speak to, everybody is voting for Geoff Diehl,” Small said Tuesday afternoon while sign-holding for his candidate. “They just can’t stomach her. … they’ve heard Geoff, they believe in him being able to work for them.”

Cullity said he saw another Scott Brown surprise, saying polls are rigged and can’t be believed, and said he viewed the Senate election as more of a referendum on Warren than Trump.

“In this area, nobody likes Trump except for crazy people like me,” he said with a laugh.

“I absolutely, positively hate a lot of what [Trump] says at times, but I love what he’s doing in office,” Small said. “This senate race here is going to be the shot heard around the country when it’s all said and done.”

Diehl’s father in-law, Joe Boss, and his friend Paul Brown had also expressed confidence in the day’s outcome.

“I’m feeling very good,” Boss said. “I think he’s worked really, really hard and the conversations I’ve had with anybody — anybody — is that, even if they are Democrats, they’re going to vote for Geoff.”

Cullity and Small had the same experiences with their talks across the state with Democrats they knew and with whom they worked.

Supporters of Democratic candidates were equally certain of their chances, although Whitman Selectman Randy LaMattina conceded that state Rep. Candidate Alex Bezanson faced a tough opponent in the eventual winner Alyson Sullivan.

“It’s guaranteed,” LaMattina said of Warren’s re-election Tuesday morning. “This state has woken up and realized the Blue Wave is here.”

He said early voting and people’s realization of the importance of the election would negate any effect a rainy forecast would have on turnout.

Key issues

Whitman resident Randy Hill echoed voter trends across the country, citing health care and Trump’s policies and divisive speech.

“I want to keep health care the way it is and to stop the Trump agenda going forward and I think we have very qualified candidates who can do so,” Hill said. “I love our chances today. The country has given the president two years to see what he can do and people are not liking the divisiveness that is projected from the president.”

Cameron Thomas, 11, who held a Bezanson sign at the polls, meanwhile said he just plain liked his candidate.

While Question 1 on patient limits was trounced 70 to 30 percent at the polls, Hanson nurse Kathy Sussky spent time in the morning holding a “Yes on 1” sign and talking to voters.

“More nurses are going to equal better, safer care for patients,” she said.  “I think it’s shameful that the ‘No’ campaign has been spreading lies about what is going to happen to ER wait times and people not being seen in the emergency room.”

The similarity in lawn sign design was an indication of that, she said, indicating she saw a tight 50-50 race on the question.

“Nurses will never turn away patients,” she said.

Election enters the final stretch

When voters go to the polls Tuesday, Nov. 6 — if they haven’t already done so under early voting provisions — the state ballot they’ll see is a lengthy one, featuring candidates in 14 races and three ballot questions.

Hanson voters, meanwhile, will see a separate town election ballot with two more questions to determine whether the town will permit recreational cannabis retailers in town.

Polls on Election Day are open from 7 a.m. to 8 p.m. Hanson voters cast ballots at Hanson Middle School for all precincts. Whitman voters cast ballots at the Town Hall Auditoriums for all precincts.

Cannabis questions

The two Hanson cannabis questions entail changes to both the General Bylaws and Zoning Bylaws, both of which require a “yes” vote to block retail cannabis businesses in the town. Whitman voters have already prohibited such sales in their town.

Hanson’s town ballot question 1 pertains to the General Bylaws and question 2 involves the Zoning Bylaws.

Voters at special Town Meeting Monday, Oct. 1 narrowly approved an article amending the General Bylaws in order to prohibit the retail sale of recreational cannabis products, but failed to achieve the two-thirds majority required by a second article to amend the town’s Zoning Bylaws.

Both will also appear on the Nov. 6 town ballot, but the zoning question is effectively moot — leaving the town to depend on a bylaw approved in May restricting retail marijuana businesses to an overlay district with frontage on Route 27, Main Street and Franklin Street.

“The reason why we have two separate bylaws on this Town Meeting warrant is because there is some question as to whether or not a General Bylaw will serve to prohibit,” said Town Counsel Katherine Feodoroff on Oct. 1. “It’s potentially challengeable.”

She said her firm would do their best to protect the town if a challenge is received.

Opponents of retail cannabis shops cite the potential for adverse effects of marijuana use on teenagers.

“Dr. Ruth Potee, M.D., of Greenfield, recently told an audience in Shrewsbury that last year, for the first time, marijuana use among teens surpassed cigarette use. And that’s a problem because early exposure to cannabis, as with early exposure to other drugs, can harm the developing brain,” the Rev. Peter Smith, recently wrote, quoting a story in the Milford Daily News. Smith is a member of W-H WILL.

“Proponents of legalized marijuana may say that legalization does not extend to minors, but who are they kidding?” Smith stated. “The more it is available, the more its use will spread, and we will all be the poorer for that.”

While proponents countered at the Oct. 1 Town Meeting that putting “another liquor store on the corner it doesn’t make you an alcoholic,” others are not convinced by that argument.

“We need to realize that marijuana and alcohol are not the same thing nor do they affect the body in the same way,” stated Hanson resident Ken Duty of County Road, citing a recent fatal East Bridgewater crash in which the 18-year-old driver was charged with driving under the influence of marijuana — in a crash that killed four other teens. Duty asks what voters would say to the parents of those killed.

“Do you say I voted and welcomed Pot and Edibles to be sold in Hanson? Not me, I want deniability saying I voted to stop marijuana sales in Hanson,” he said.

Patrick Powers of Holmes Street reported, during the Town Meeting, that health department reports in Colorado and Washington both found that marijuana use actually decreased among youth in grades six through 12 after legalization as well as a 6.5 decrease in opioid overdose deaths. He also said children are not allowed in cannabis shops where customers must show ID to enter and wait in a waiting room before they are assisted by a certified employee who has passed background checks.

Joseph Campbell of Woodbine Avenue argued that Hanson would benefit from tax revenue on both the local and state level, noting that similar towns out west have benefits for land-locked towns with slowing growth.

“We have an opportunity knocking at our door,” Campbell said Oct. 1, noting individual moral decisions must take place in the home. “If you have a liquor store at the end of your street, is that going to make you an alcoholic? Probably not.”

He stressed that the Board of Selectmen will retain the right to grant or rescind licenses as well as bestowing the financial “gifts” of taxes from the businesses to public safety and school needs.

The candidates

Topping the State Ballot is the race for U.S. Senator, with incumbent Elizabeth Warren, D-Mass., facing state Rep. Geoff Diehl, R-Whitman, and Independent candidate Shiva Ayyadurai of Belmont.

Republican incumbent Gov. Charlie Baker and Lt. Gov. Karyn Polito are being challenged by Democratic challengers Jay Gonzalez, a former Secretary of Administration and Finance under Deval Patrick, and his running mate for lieutenant governor, Quentin Palfrey who served in the White House under President Obama as a senior advisor for jobs and competitiveness, and as a deputy general counsel in the U.S. Department of Commerce.

Incumbent Attorney General Maura Healey, a Democrat, is facing a challenge from Republican James R. McMahon III of Bourne.

Secretary of State William Galvin, a Democrat, is being challenged by Republican Anthony M. Amore of Swampscott, and Green-Rainbow candidate Juan G. Sanchez Jr., of Holyoke.

Democratic state Treasurer Deborah B. Goldberg, the incumbent, is on the ballot with Republican candidate Keiko M. Orrall of Lakeville and Green-Rainbow candidate Jamie M. Guerin of Northampton.

For state Auditor, Democratic incumbent Suzanne M. Bump faces Republican Helen Brady of Concord, Libertarian Daniel Fishman of Beverly and Green-Rainbow candidate Edward J. Stamas of Northampton.

Both 8th District U.S. Rep. Stephen F. Lynch, D-Mass., and Governor’s Councillor Christopher A. Iannalla Jr., are unchallenged on the ballot, save for write-in candidate for Governor’s Councillor Erin Johnson. In the 9th congressional district, Hanson voters will see incumbent Bill Keating, D-Mass., is challenged by Republican Peter D. Tedeschi of Marshfield.

Incumbent state Sen. Michael D. Brady, D-Brockton, is being challenged by Republican Scott Hall of Brockton.

Brady is currently seeking re-election for his third term for the district, which represents Plympton, Halifax, Hanson, Whitman, Brockton, and parts of East Bridgewater and Easton. Prior to becoming a senator, he served four terms as State Representative in the Ninth Plymouth District.

As chairman of the Senate Committee on Revenue where he has worked to provide funding for the district for education, public safety, infrastructure, seniors and veterans, according to a statement from Brady’s campaign.

“Senator Brady will continue to support and fund and protecting public education, incentives for renewable energy resources, opioid abuse prevention, helping veterans, the elderly, and increasing economic development,” his campaign stated.  “He says that constituent services have always been his top priority and will continue to do so if re-elected.”

State Rep. races

Hanson state Rep. Josh Cutler, D-Duxbury in the 6th Plymouth District, is unopposed for re-election.

In Whitman, seeking the seat vacated by Diehl in the 7th Plymouth District, candidates Alex Bezanson, a Democrat, and Alyson Sullivan, a Republican are on the ballot. Both are Abington residents in a district that includes all of Whitman and Abington and precincts 2, 3 and 4 in East Bridgewater.

Bezanson and Sullivan met in a WATD political forum broadcast on Whitman-Hanson Community Access TV on Monday, Oct. 8.

A Quincy native, Bezanson moved to Abington in 1987 and owns a contracting business. He has served on the Abington Conservation Commission, Water Commission and Board of Selectmen. He and his wife founded the HUG Foundation that aids families facing medical issues and the Abington Substance Awareness Coalition as a resource for families of addicts and to promote awareness of the problem for students and parents.

Sullivan, a lifelong resident of Abington, and a law student in her final year at the Suffolk University School of Law, has worked as a legal assistant in the U.S. Immigration Court before joining the U.S. Attorney’s Office for the Massachusetts District in its victim/witness unit. She is currently a legal assistant in the state’s Executive Office of Administration and Finance.

The WATD debate touched of issues of climate change and the need for renewable energy — which both supported, the importance of municipal experience in the State House; 40B affordable housing issues; business development and challenges to it, public transportation needs; ballot question 2 limiting corporate contributions to political campaigns — which Sullivan opposes as a free speech issue and Bezanson supports, but concedes is not germane to local races; use of state surplus and criminal justice reform.

The debate is posted on the WHCA-TV YouTube channel for streaming.

Incumbent DA Timothy Cruz, a Republican, is facing a challenge from Democrat John E. Bradley Jr., of Plymouth.

Other unchallenged candidates on the ballot are: Democrat Robert S. Creedon Jr., for Plymouth County Clerk of Courts; Democrat John R. Buckley Jr., of Brockton for Register of Deeds and Republican Sandra M. Wright for County Commissioner.

Question 1, regarding whether or not limits should be placed on the number of patients that could be assigned to one registered nurse, has received the most attention.

A yes vote would place limits in, what proponents say is in the interest of quality care. A no vote makes no change to current laws to avoid what opponents of the question see as putting “patient care quality and safety at risk.”

Question 2 would create a citizens commission to promote an amendment to the U.S. Constitution limiting the influence of money in elections and reversing a Supreme Court ruling that corporations have the same rights as human beings.

A yes vote supports such an effort. A no vote would not create such a commission.

Question 3 adds gender identity to the list of prohibited grounds for discrimination in places of public accommodation, resort or amusement. A yes vote retains the current law, which prohibits discrimination on the basis of gender identity. A no vote would repeal that protection under the public accommodation law.

Whitman gains state IT grant

WHITMAN — Fire Chief Timothy Grenno and town IT Director Joshua MacNeil announced at the Tuesday, Oct. 23 Selectmen’s meeting that Whitman has received a $199,601 state Community Compact IT Grant.

The funds will enable the town to make improvements to radio communication infrastructure to improve coverage for police and fire operations.

Selectmen and Planning Board members also met jointly and voted to appoint Elaine Bergeron and Adam Somerville to the Planning Board to fill vacancies. Both terms expire May 18. The Planning Board will keep résumés of candidates Adele Carew and Jerry Blumenthal on file in case another vacancy crops up. All four were encouraged to run for office in the next Town Election.

Grenno and MacNeil, reporting on the communications grant, said Whitman was among 44 communities receiving the funds for Fiscal 2019 — and was awarded the most cash on the list.

“When it gets into public safety, the fire and police departments’ communication systems are pretty much their lifeline,” Grenno said. Last year he and Police Chief Scott Benton sat down with MacNeil and Town Administrator Frank Lynam to assess the communications infrastructure in town and submitted an article to the Finance Committee to replace the radio systems and network.

“Mine is 11 years old and [Benton’s] have been failing at alarming rates,” Grenno said. “There just wasn’t funding for it last year and we were looking for different options.”

The Community Compact IT Grant provides $2 million to eligible communities with a cap of $200,000 per project, according to MacNeil.

“We’re always looking for ways that we can do better and provide what we can for the community at little to no cost and this is a great example,” he said, noting that a small portion of the work would still need to be added later. But the main goal was to provide full coverage to Whitman Middle School and WHRHS.

“Those two buildings have some deficiencies that are problematic and, unfortunately, public safety — when they’re trying to communicate — receiving communications in those buildings is very difficult at times and has interrupted communications on different incidents,” MacNeil said.

National Grid

Grenno also reported that concerns voiced on gas leaks reported at the intersection of routes 18 and 14.

“I’ll tell you that there was a Grade One leak at that intersection back in September,” Grenno said. “The gas company did respond, they deemed it a Grade One leak, they had crews there that evening and that Grade One leak was repaired in the overnight hours that night.”

He said there have been two or three Grade One leaks since the National Grid lockout started four months ago, but he has not seen any effect on response time to major problems despite the labor dispute.

“It’s a tough time right now, both Columbia Gas and National Grid have a moratorium against them,” he said. “It’s not pretty out there in the gas world, but as far as this town goes whatever Grade One leaks we have had have been handled in a timely fashion.”

Planning Board

The interviews with Planning Board candidates were among the first orders of business before Selectmen Tuesday. Somerville received seven votes, and on a second ballot between Bergeron and Blumenthal — Bergeron then garnered six votes. The new members were then sworn in by Town Clerk Dawn Varley, so they could attend the evening’s Planning Board meeting.

Somerville, has been a gas company sub for 25 years with experience in underground utilities including water and electric as well as gas. He also has construction experience and had owned his own residential building company for about eight years.

“As long as I know a couple of days ahead of time, I could be anywhere at any time,” he said of his availability for meetings.

Bergeron, who interviewed with both boards Sept. 24, has served on the Finance Committee in the 1970s and has been a member of the Whitman-Hanson Scholarship Foundation for almost 40 years as well as serving as an election worker. She is currently a senior vice president director of personal insurance, overseeing a staff of 60 both directly and indirectly, for a large insurance agency. Among her duties are figuring out what houses are worth and how they should be insured.

Blumenthal had to leave the Sept. 24 meeting early, due to a family emergency, and Somerville interviewed this week. He is also a former Finance Committee member. A civil engineer on municipal transportation projects as well as for state and private colleges and universities Blumenthal has been a resident engineer for the Division of Capital Asset Management and Maintenance, and is retiring next week. He had also served on the School Building Committee that worked on WHRHS, but has limited experience in residential development.
